While equal protection and free speech will be tested on the MBE, they may not come up as much as one might think (for the MBE that is - they are very likely to come up as essay questions on the bar exam). For the MBE, it's fair to say that at least half of the Con Law questions will probably come from other areas (e.g., federalism, executive powers, congressional powers, commerce clause, etc.). Generally, there are many questions concerning the interrelationship between federal and state or local laws. This theme is often tested under general federalism issues, specifically the Commerce Clause.
